Note: This privacy policy applies to our collection, use, and disclosure of data received or created when you access and use certain items provided by us, “Sesh Fitness App LLC DBA SeshDx” (referred to here as “SeshDx,” “Sesh Diagnostics”, “Sesh,” “we,” “us,” or “our”). Your Consent
By accessing or using the Site or Services, you are consenting to our processing of the information described in this Privacy Policy. “Processing” means using cookies on a computer or mobile device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining, and disclosing information. Information processed by the Site and Services will be transferred, processed, and stored in accordance with United States state and federal law. The Services are intended for use by residents of the United States only.
WE MAY USE COOKIES, PIXELS, AND OTHER TRACKING TECHNOLOGIES, INCLUDING THIRD-PARTY TRACKING TECHNOLOGIES (COLLECTIVELY, “ADTECH”) ON THE SITE AND SERVICES. What information is collected by the Site and Services and how is it used?
We collect certain personal information described in this Privacy Policy from you when you access and/or submit information to us through the Site or Services (“User Information”). We retain User Information to provide you with the Site and Services. We process and handle User Information as defined in this Privacy Policy.
What Categories of Information do we collect and how do we use it?
Identifiers
Examples of Identifiers we Collect: Your name, alias, unique personal device identifier, email address, phone number, mailing address, date of birth, and other identifying information you provide when creating an account, using our Services, or contacting us (“User Information”).
How Long we Retain Identifiers: We store this information as you continue to use the Site or Services; while we keep a business relationship with you; and as required for any other business or legal purpose.
We may use User Information that we collect from you to contact you or send you information, for example, to send you our newsletters, marketing or promotional materials, and other information that we think may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.
We may also retain records of your communications with us, including messages sent through the Services, emails, and customer support interactions, to respond to your inquiries and improve our Services.
Health and Medical Information
Examples of Health Information we Collect: Health history, current medications, allergies, symptoms, medical conditions, lab test orders and results, telehealth consultation information, fitness and wellness data (including workout data, progress photos, health metrics, and personal goals), intake forms, wellness history, and other health-related information you provide through the Services (“Health Information”). Health Information may constitute “sensitive personal information” under certain state privacy laws.
How Long we Retain Health Information: We retain Health Information for so long as you maintain an account with us; while we keep a business relationship with you; for so long as required for any other business or legal purpose; and as required by applicable law.
Payment Information
Examples of Payment Information we Collect: Credit or debit card information, billing address, and other payment-related information you provide when purchasing services or when we collect fees on behalf of third-party health care providers, pharmacies, or laboratories (“Payment Information”). Payments are processed by third-party processors such as Stripe. We do not store full payment card details. Please review Stripe’s Privacy Policy at https://stripe.com/privacy.
How Long we Retain Payment Information: We retain Payment Information for so long as you maintain an account with us; to process transactions and chargebacks; and as required for any other business or legal purpose.
Biometric and Authentication Information
Examples of Biometric Information we Collect: If you choose to use biometric authentication features (such as Face ID or Touch ID) or passkey authentication, your device may collect biometric data to authenticate you. We do not directly store your biometric data; rather, authentication is handled by your device or authentication provider (such as Apple or Google). We may receive confirmation that you have successfully authenticated (“Authentication Information”).
How Long we Retain Authentication Information: We retain confirmation of authentication events for so long as you maintain an account with us and as required for security and fraud prevention purposes.
Internet Activity
Examples of Information we Collect Through Internet Activity: Internet or other electronic network activity information, including the websites you visit before or after you visit the Site, the date and time you visited our Site or Services, search history, information regarding your interactions on our Site and Services, including online identifiers like cookie ID, browser type, your internet service provider, operating system, device type, MAC address, IP address, application, or advertisement (“Usage Data”). Some Usage Data, such as IP address, may capture your geographic location.
How Long We Retain Internet Activity: We retain this information for so long as you maintain an account with us; while we keep a business relationship with you; and for so long as required for any other business or legal purpose.
Collectively User Information, Health Information, Payment Information, Authentication Information, and Usage Data will be referred to as “Site Data”. Site Data will be used by us either individually or in aggregated form to enhance and improve the Site and Services, to provide personalized recommendations, and to operate AI-powered features.
How We Use Your Information
We use the information we collect for the following purposes:
To provide and operate the Services – including facilitating laboratory testing, telehealth consultations, coaching services, and interpreting lab results for educational purposes;
To communicate with you – including service updates, appointment reminders, support responses, and scheduling communications;
To process payments and prevent fraud – including processing transactions, detecting and preventing fraudulent activity, and managing chargebacks;
To improve and personalize the Services – including analyzing usage patterns, developing new features, and providing personalized recommendations;
To market our Services – including sending promotional materials, newsletters, and other information we think may interest you (you can opt out of marketing emails at any time);
To comply with legal obligations – including responding to legal process, enforcing our agreements, and protecting the rights, property, or safety of SeshDx, our users, or others.
AI and Machine Learning
The Services may leverage machine learning, large language models, or other artificial intelligence technologies to provide personalized recommendations and other features. When you use AI-powered features, your inputs and interactions may be processed to generate responses and improve the Services. AI-generated content is for informational and educational purposes only and should not be relied upon as medical advice.
Monitoring
SeshDx has the right, but not the obligation, to monitor use of the Services and electronic communications transmitted through the Services. We may share content, records, or communications if permitted by law, in response to government requests, to operate the Services, or to protect the rights, property, or safety of SeshDx, our users, or others.
What AdTech do we use on the Site?
Cookies.
Cookies are pieces of information stored directly on your device. Cookies allow us to collect information such as browser type, time spent on our Site or Services, pages visited, language preferences, and other anonymous traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience while using the Site and Services and to enhance user engagement. We also use cookies to gather statistical information about use of the Site and Services to continually improve its design and functionality, to understand how it is used, and to answer questions regarding the Site and Services. We may also use cookies for advertising purposes. Among other uses, these cookies limit the number of times you may see our advertisements and help us measure the effectiveness of our outreach campaigns.
Tracking Technologies
Advertising companies and analytics providers that we work with also may place cookies or tracking pixels on our behalf. They may track that you have visited this Site or Services, and we then share this information with the advertising network, either automatically, or manually (this practice is sometimes referred to as “retargeting”). Do third parties see and/or have access to information obtained by the Services?
Site Data may be shared with third parties in the following circumstances:
Service Providers. We share Site Data with third-party service providers who host and support the Services on SeshDx’s behalf. These service providers do not have any right to independently use any Site Data that we share with them.
Third-Party Health Care Providers. If you use our telehealth facilitation services, we share your Health Information with independent, third-party licensed health care providers who may provide telehealth consultations and, in their independent professional judgment, prescribe medications. These health care providers are independent contractors, not employees of SeshDx, and have their own privacy practices. We encourage you to review their privacy policies.
Protected health information collected during telehealth visits and prescribing through SeshDx is governed by the Notice of Privacy Practices of the professional corporation that provides your clinical care. Please review the full Notice here: https://openloophealth.com/notice-of-privacy-practices
Third-Party Laboratories. If you use our laboratory testing services, we share your Health Information with independent, third-party laboratories that perform the testing. These laboratories are independent entities with their own privacy practices. Lab results may be subject to the laboratory’s own privacy practices.
Third-Party Pharmacies. If a health care provider prescribes medication through our Services, we may share your information with independent, third-party pharmacies to fulfill prescriptions. These pharmacies are independent entities with their own privacy practices.
Payment Processors. We share Payment Information with third-party payment processors to process transactions. SeshDx may also collect professional fees, consultation fees, and prescription costs on behalf of third-party health care providers and pharmacies as a payment facilitator. Such fees are passed through without markup, commission, or set-off by SeshDx.
Authentication Providers. If you use single sign-on (SSO) features such as Sign in with Apple or Sign in with Google, or passkey authentication, information may be shared with those authentication providers in accordance with their privacy policies.
Legal and Compliance. We may share Site Data if permitted by law, in response to government requests, to operate the Services, or to protect the rights, property, or safety of SeshDx, our users, or others.
Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred to a successor entity or purchaser, where permitted by law. We will provide notice if your information becomes subject to a different privacy policy.
No Sale of Personal Information. We do not sell your personal information in the ordinary course of business.
What are my opt-out rights?
We only collect the Site Data that is necessary to provide you with the Site and Services. Because of this, the only way to opt out of certain information collection is by stopping using the Site or Services. If you do not wish to receive marketing emails from us, you can opt out of future marketing emails by following the instructions provided in the marketing emails. Opting out of marketing emails will not affect our administrative emails to you. Please note that push notifications sent through the Services may be visible to anyone with access to your device.
Do Not Track. Some web browsers may transmit “Do Not Track” signals to websites. We do not currently respond to “Do Not Track” signals or similar mechanisms. However, you may be able to opt out of certain tracking through the advertising network links provided above, through your browser settings, or through industry opt-out tools such as the Digital Advertising Alliance’s opt-out page at https://optout.aboutads.info.
Targeted Advertising. We may use Site Data to deliver targeted advertising to you. You may opt out of targeted advertising by adjusting your settings with the advertising networks listed above, using industry opt-out tools, or exercising your state privacy rights as described in the “State-Specific Privacy Rights” section below.
Data retention policy
We retain personal information as long as you use the Site or Services, and for a reasonable period after you stop using the Site or Services. We use and retain Site Data, in both individualized and in aggregate form, as necessary for business purposes, legal compliance, dispute resolution, and agreement enforcement. Information may persist in backups for a reasonable period.
Your Personal Information Rights
You may make certain requests regarding our use of your personal information by emailing us at support@seshdiagnostics.com. Please include “Privacy Request” in the subject line of your email.
Account Deletion. You may request deletion of your account by emailing us at support@seshdiagnostics.com or through your account settings. Please note that we may retain certain information as required by law, for legitimate business purposes, or to complete pending transactions. Certain information may also be retained for legal compliance, dispute resolution, and agreement enforcement.
Verification. To protect your privacy and security, we may take steps to verify your identity before responding to your request. Verification may include confirming your email address, account information, or other identifying information. If we cannot verify your identity, we may be unable to fulfill your request.
Response Timeframe. We will respond to verifiable requests within the timeframes required by applicable law. For California residents, we will respond within 45 days of receiving your request. If we need additional time (up to an additional 45 days), we will notify you of the reason and extension period in writing.
Authorized Agents. You may designate an authorized agent to submit a request on your behalf. To do so, you must provide the authorized agent with written permission to act on your behalf, and we may require you to verify your identity directly with us and confirm that you have authorized the agent to act on your behalf.
Age Requirements
The Site and Services are not designed or intended for use by persons under the age of 18. By using the Services, you represent that you are at least 18 years of age. If you are under 18, you must have the consent of a parent or legal guardian to use the Services. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at support@seshdiagnostics.com so we can promptly delete such information.
Security
We are concerned about protecting the confidentiality of all information that we interact with in providing the Site and Services. We and our service providers use physical, electronic, and procedural safeguards to protect the information that we process and maintain. Although we strive to provide security for the information that we process and maintain based on the sensitivity of that information, no security system can prevent all potential security breaches. We cannot guarantee absolute security of your information.
Important Notice Regarding HIPAA
SeshDx is a wellness platform and is not itself a HIPAA covered entity. However, the licensed clinicians, pharmacies, and laboratories that provide care through our platform ARE subject to HIPAA. Protected health information collected during your telehealth visits, lab testing, and prescribing is governed by the Notice of Privacy Practices of the professional corporation providing your care, available at seshdiagnostics.com/legal/consumer-health-data-privacy-policy. Health-related information you provide to SeshDx outside of clinical care (e.g., wellness goals, fitness data, intake before you're connected to a clinician) is governed by this Site Privacy Policy.
In addition to the security safeguards we provide, we urge you to take precautionary measures in maintaining the integrity of your data. Please be responsible for making sure that no one can see or access your account or log-in/password information, or your mobile device.
Links to other sites and services
The Site or Services may contain links to other sites or services that are not operated by us. If you click an outside link, you will be directed to that outside site or service. We strongly advise you to review the privacy policy of every site you visit. We are not responsible for the privacy practices or the content of any outside sites or services.
International Visitors
The Site and Services are intended for users located in the United States. If you access the Site or Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, which may have data protection laws that differ from the laws of your country. By using the Site or Services, you consent to the transfer of your information to the United States.
State-Specific Privacy Rights
California Residents. If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), including the right to know what personal information we collect, use, disclose, and sell; the right to delete personal information; the right to correct inaccurate personal information; the right to limit the use and disclosure of sensitive personal information; and the right to opt out of the sale or sharing of personal information for cross-context behavioral advertising. California “Shine the Light” Law. Under California Civil Code Section 1798.83, California residents who have an established business relationship with us may request information about whether we have disclosed personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their own direct marketing purposes without your consent.
Consumer Health Data. Certain states, including Washington, Nevada, and Connecticut, have enacted laws that provide additional protections for “consumer health data” as defined under those laws. Changes
We reserve the right to modify this Privacy Policy at any time in our sole discretion by including such alteration and/or modification in this Privacy Policy, along with a notice of the effective date of such modified Privacy Policy.
